INphotography Limited (we, our or us) is committed to safeguarding the privacy of individuals who visit the website http://www.inphotography.co.nz/ and/or provide us with personal information when using our services. This Privacy Policy sets out how we collect, hold, use, and disclose your personal information.  By using our Website, purchasing from us or agreeing to accept products or services from us, you consent to our use of your personal information in accordance with this Privacy Policy.

In some cases this may require you to opt out through our clients that we source the data from. Please note that if you elect not to provide certain information to us, we may not be able to provide you with the services, products or information you require.

  • demographic information such as postcode and preferences

  • other information relevant to order processing and/or offers

 If you are part of a school, sports, corporate or other organisation or group using our services, you agree that we may collect personal information about you from that school, sports, corporate or other organisation or group and that you have authorised them to disclose your personal information to us and consent to our use of your personal information in accordance with this Privacy Policy. 

What do we use your information for?

We will only use and disclose your personal information for the purposes for which it was collected (or otherwise as required or authorised by law). This may include using your personal information for the following purposes:

  • To supply our client with works they contract us to provide.
  • to match your photograph to your name and school, sports, corporate or other organisation or group
  • to administer promotions or market and sell photographs and other products to the public
  • to provide you with products or services and to personalise your experience;
  • for our administrative purposes and for internal record keeping;
  • to improve our Website;
  • to undertake customer service activities such as responding to any queries, comments or complaints you may have;
  • to send periodic emails. The email address you provide may be used to send you information, respond to inquiries, and/or other requests or questions;
  • to comply with relevant laws and regulations; and
  • for any other specific purpose which we notify you at the time your personal information is collected.

    Who do we disclose information to?

    For the purposes we have described above, we may disclose your personal information:

    • to other members of your school, sports or other group and their families, relations or representatives;
    • to members of the public for marketing, promotional, sales and other business purposes.
    • where you have consented to the disclosure;
    • to our professional advisers or as otherwise required for our business purposes;
    • to our clients or suppliers who assist us in operating our Website, conducting our business, or providing services to you, so long as those parties agree to keep this information confidential; or
    • as otherwise required or authorised by law.

    You acknowledge that we cannot control the use of any photographs once they are purchased from us, or supplied by us, and that photos used and/or published by purchasers may contain your personal information.

    How long do we store your information for?

    You acknowledge that INphotography, in keeping with its Privacy Act obligations, will only keep copies of any final photographs and associated data supplied under this Agreement for a reasonable time to allow for reprints or resupply to the Client or the subjects. INphotography is therefore unable to guarantee that any of the final photographs supplied under this Agreement will be available upon request.

    How do we protect your information?

    We are committed to ensuring that your information is secure and we comply with our obligations under the Privacy Act 2020 in relation to the storage and security of your personal information that is held by us. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.

    We remind you, however, that if you send information to our Website, the internet is not a secure environment and we cannot warrant or guarantee the security of information you send to us while it is being transmitted.

    Our facial recognition technology was introduced and tested with four of our local Colleges in 2024 with great success. From 2025 this technology will be utilised in our standard workflows for efficiency. For your privacy and security, the face detection and recognition data is stored securely in an encrypted MySQL database on our server to ensure confidentiality. While group photographs and individual portraits are made available online for ordering purposes, including captions with student names, the biometric face signature data is never sent to, nor stored in, the cloud or any external service. The biometric face signature is used only internally for matching purposes and remains securely stored on our servers.

    We use cookies to understand and save your preferences for future visits and compile aggregate data about Website traffic and Website interaction so that we can offer better Website experiences and tools in the future. We may contract with third-party service providers to assist us in better understanding our site visitors. These service providers are not permitted to use any personal information collected on our behalf except to help us conduct and improve our business.

To the fullest extent permitted by law, we accept no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our Website and welcome any feedback about these sites.

    Controlling your personal information

    When using parts of our website you may encounter forms to fill out with your email address or other personal information at which time you will have the option whether we may contact you pertaining to that form or event.

    If you have created an account with us, you can update your account information at any time by logged into your account and using the My Account area.

    If you wish to have your information removed from our system, you may email us at brooke@inphotography.nz with your request and we will process that as soon as possible.

     We rely on the data supplied by our school and club clients as our master document. We rely on the information supplied to be correct. Our practice includes a proofing process whereby our client must review any final works and advise of any corrections before the final works are disclosed/released for supply or purchase. If you find that the information used by us in the final supply of works is still inaccurate you may contact us – brooke@inphotography.nz and we will rectify the error within a reasonable timeframe in any digital works. We cannot guarantee that we will replace any already supplied printed works at our expense. In some cases, the client may be liable for the related costs.

     Information supplied to us may include an unique identifier (UI) assigned to you by your organisation (school). We too assign this UI to your image (as your image filename) for the purpose of supplying your identification image back to the school and to an ID card company (on behalf of your school) for the production of ID cards. When you use our website to review our works the passcode assigned to you may include your UI (with a common prefix) for convenience of your access.
